The Federal Constitutional Court has disposed of a case related to illegal constructions in Karachi, while withdrawing its earlier decision regarding restrictions on converting residential plots into commercial use.
However, the court maintained that public spaces including parks, hospitals and playgrounds cannot be reclassified or altered under any circumstances.
During proceedings, Justice Aamer Farooq observed that the court would not interfere in the working of institutions such as the Sindh Building Control Authority. He stated that if any authority violates the law, affected parties should approach the relevant forum or the High Court.
He further remarked that if justice is not provided at the High Court level, an appeal can be filed, adding that the power of suo motu action no longer exists under the current legal framework.
Justice Aamer Farooq emphasized that courts cannot legislate but can only ensure implementation of existing laws. He expressed hope that town planning institutions would perform their duties in good faith.
The bench also noted that Supreme Court decisions regarding changes in land use categories would not obstruct the functioning of relevant administrative bodies.
Justice Arshad Hussain remarked that strict action would be taken against any officer found violating the law.
The court concluded that enforcement of building regulations remains the responsibility of concerned institutions, and legal remedies are available for grievances through proper judicial channels.
