Open Society drafts ICJ case against Taliban

LAHORE (Lord Media): Open Society Foundations has prepared a legal draft to file a case against the Afghan Taliban in the International Court of Justice. The case aims to prosecute the Taliban for severe violations of the 2003 Women’s Rights Convention.

Binaifer Nowrojee, President of Open Society Foundations, stated that since the withdrawal of allied forces in August 2021, the Taliban have issued over 100 unlawful decrees against women.

She further explained that Afghan women face strict restrictions on leaving home without a male guardian, working, and pursuing education beyond sixth grade.

Members of the United Nations and the European Parliament have labeled the situation in Afghanistan as gender discrimination. Following a legal notice from Australia, Canada, Germany, and the Netherlands in September 2024, this case will serve as a significant pressure tool against the Taliban.

According to the President of Open Society Foundations, UN legal action and sustained global pressure are decisive weapons for restoring Afghan women’s rights and ending oppressive restrictions.

Global experts assert that the harsh laws in Afghanistan have made life unbearable for ordinary citizens, depriving women and girls of basic rights.

Experts believe that legal proceedings against the Taliban regime in the International Court of Justice will increase political and diplomatic pressure on them and damage their global reputation.
