Islamabad (Lord Media): The Federal Constitutional Court has ruled that the registrar does not have the authority to declare petitions inadmissible and return them. Justice Hasan Azhar Rizvi issued a six-page order stating that only the court can determine the admissibility of a petition, while the registrar’s office can only impose administrative objections.
The court clarified that the registrar’s office can return a petition only if it is filed against the rules and cannot exercise judicial powers. The decision stated that granting judicial authority to an administrative officer contradicts the constitutional separation of powers. The registrar’s office also cannot deem a constitutional petition as frivolous.
It is noteworthy that the registrar’s office had returned Razia Aslam’s constitutional petition on February 14, citing it as inadmissible, leading the petitioner to file a chamber appeal.
