Court rules on minors’ rights in inheritance case

Lahore (Lord Media): The Lahore High Court has issued a significant ruling on the rights of minors, stating that parents cannot waive a child’s maintenance and inheritance rights through any agreement. Justice Mohsin Akhtar Kayani released the written judgment in response to a petition by Muhammad Waleed Arshad, establishing key legal principles regarding minors’ rights.

According to the decision, the agreement between the parties involved the mother renouncing the minor child’s maintenance and inheritance rights. However, the court declared that a child’s maintenance is a continuous legal, moral, and religious obligation of the father.

The court emphasized that parental consent cannot legalize any agreement that goes against the child’s interests. Any clause attempting to terminate or relinquish a minor’s future inheritance rights is deemed illegal from the outset.

The court directed family courts not to accept any agreements concerning minors based solely on parental consent. Instead, a thorough review of the child’s best interests, welfare, and legal rights must be conducted in every case.
