ISLAMABAD (Lord Media): The Federal Constitutional Court has overturned the Supreme Court’s decision to demolish the Monal Restaurant in Pir Sohawa. The court accepted the appeals from the Capital Development Authority (CDA) and the Metropolitan City, also lifting the injunction. Trial courts have been instructed to expedite the case decisions.
The court stated that trial courts should decide ownership without being influenced by judicial observations. Administrative decisions will be made under regulatory bodies.
Justice Hasan Rizvi noted that several points were overlooked in the Supreme Court’s decision. He emphasized that decisions should be based on facts rather than emotions.
Lawyer Ahsan Bhoon praised the court’s decision, to which Justice Hasan Azhar Rizvi responded that there is no need for praise in court; decisions will be made based on the hearings.
