Washington (Lord Media): The U.S. Supreme Court has partially lifted the federal ban on gun ownership for individuals who use marijuana, limiting the restrictions imposed by the federal government. In a unanimous decision, the court stated that a person cannot be prohibited from possessing firearms solely based on marijuana use unless it is proven they pose a threat to others.
This ruling narrows the interpretation of federal law, which previously criminalized gun possession for illegal drug users and carried a penalty of up to 15 years imprisonment.
The case was brought by Ali Hemani, a Texas resident, who admitted to using marijuana and possessing a 9mm pistol at home. The Supreme Court upheld the lower court’s decision, declaring the charges against him unconstitutional.
The court also clarified that the ruling does not grant unconditional gun rights to all drug users. Restrictions on firearm possession for drug addicts remain in place.
While marijuana is legally recognized in over 40 U.S. states, it remains a prohibited substance under federal law.
