The Lahore High Court has ruled that all property-related cases involving overseas Pakistanis will be heard exclusively in special courts established under the Overseas Pakistanis Property Act.<\/p>\n
In a significant verdict regarding overseas Pakistanis\u2019 properties, the court declared invalid the objection raised by special courts refusing to hear such cases.<\/p>\n
The court observed that the jurisdiction of special courts is not limited to possession and ownership disputes alone, but extends to all matters related to properties owned by overseas Pakistanis.<\/p>\n
According to the ruling, cases involving inheritance, mutation, power of attorney, movable and immovable properties will also be heard by special courts.<\/p>\n
The court stated that the objective of the Overseas Property Act is to protect the properties of overseas Pakistanis and ensure that their cases are decided through dedicated forums.<\/p>\n
The verdict further noted that both civil courts and special courts had previously misinterpreted the law by transferring only movable property cases involving overseas Pakistanis, adding that litigants could not be subjected to \u201cping-pong\u201d between courts due to conflicting interpretations.<\/p>\n
The court clarified that if even one party in a dispute is an overseas Pakistani, the matter will fall under the jurisdiction of a special court.<\/p>\n
It also ordered that cases transferred from civil courts to special courts would continue from the same stage without requiring fresh filing.<\/p>\n
The high court termed the special court a specialized and autonomous forum for overseas Pakistanis\u2019 property disputes and directed all district and session judges to ensure implementation of the verdict.<\/p>\n
